UN rights experts apprised of violation of rights of indigenous Pradhan Newars for construction of a mega business complex

Kathmandu, 9 Feb

Two non-governmental organizations have submitted an urgent communication to UN rights experts alleging that a Nepali private company has unlawfully acquired the communal trust lands of indigenous Pradhan Newar community of Kathmandu to construct a mega business complex. As a result, the religious and cultural customs and traditions of Pradhan Newars based on the pond and its embankment lands have been devastated and thus their cultural rights and rights to cultural rights and rights to lands and resources violated, the communication reads.

Lawyers' Association for Human Rights of Nepalese Indigenous Peoples and National Coalition Against Racial Discrimination jointly submitted the communication to the UN Special Rapporteurs on the Rights of Indigenous Peoples and in the field of cultural rights on Monday. They have urged the Special Rapporteurs to correspond with the Government of Nepal about the need to take immediate action to defend, protect and promote the rights of the indigenous Pradhan Newars to their land, resources, sacred places and culture.

काठमाडौँको पर्यटकीय क्षेत्रमा निर्माणाधीन “ठमेलभित्रको ठमेल” भनेर चिनाइएको छायाँदेवी कम्प्लेक्सको निर्माणको लागि नजिकै रहेको थं विहारका परम्परागत कार्यको लागि प्रयोग गरिँदै आएको प्राचीन कमल पोखरीको गुठी जग्गा गैरकानुनीरुपमा हरण गरिएको भन्दै त्यस्तो निर्माण कार्य रोक्न अन्तरिम आदेशसहित सो जग्गालाई सार्वजनिक नै कायम गर्न उत्प्रेषणयुक्त परमादेश लगायत को माग गर्दै सर्वोच्च अदालतमा मंगलबार रिट निवेदन दर्ता गरिएको छ ।

सात व्यवसायीको ३ अर्ब रुपैयाँ लगानी रहेको सेन्टर आगामी दुई वर्षभित्र संचालनमा आइसक्ने छ । मल्ल होटलको पछाडी करिव १५ रोपनी क्षेत्रफलमा छायाँदेवी कम्प्लेक्सले व्यवसायिक भवन निर्माण गर्न लागिएको हो । सो कम्प्लेक्सको निर्माणको लागि नजिकै रहेको थं विहार (विक्रमशील महाविहार)को परम्परागत धर्मकृतिको लागि प्रयोग हुने गरेको कमल पोखरीको जग्गा पनि प्रयोग गर्न लागिएकोे छ । उक्त विषयमा उक्त महाविहारका ६ जना गुठियारहरुले पोखरी गुठी जग्गाको रुपमा सार्वजनिक नै रहनुपर्ने माग गर्दै काठमाडौँ जिल्ला अदालतमा मुद्दा दायर गरी मुद्दा विचाराधिन अवस्थामै रहँदा पोखरी भित्र पर्ने गरी निर्माणस्थल वरिपरि पर्खाल लगाएर कम्प्लेक्सको निर्माणकार्य धमाधम अघि बढाइएको छ ।

गोरखाको आदिवासी समुदायका पानीका परम्परागत मुहानमा पहुँचमाथि अवरोध गरिएको सम्बन्धि गरिएको अनौपचारिक उजुरीको प्रतिक्रियामा अख्तियार दुरुपयोग अनुसन्धान आयोगले उजुरी सम्बन्धित निकायमा पेश गरिएको जानकारी दिएको छ ।

जिल्लाको बक्रांग गाविसका आदिवासी गुरुङ र मगरहरुले खानेपानी, सिंचाई लगायतका प्रयोजनका लागि परापुर्वकालदेखि प्रयोग गर्दै आएका गाउँका दुई मुहानको सार्वजनिक जग्गा केही स्थानीय र जग्गा दर्ता तथा नापजाँचका अधिकारीहरुको मिलेमतोमा २०६४ सालमा व्यक्तिको नाममा बेचिएको थियो । समुदायलाई कुनै जानकारी बेगर जग्गाधनीले २०६९ साल असारमा पानीको मुहान थुनी अन्य गाउँमा बेच्ने कार्य थालनी गर्दा समुदायले विरोध गरेपछि निर्माण कार्य रोकिएको थियो ।

तथापि, समुदायको विरोधको बावजुद स्थानीय प्रहरी र प्रशासनको सहयोगमा जग्गाधनीले २०७० साल बैशाखबाट    पानी बेच्न थालेका छन् भने तिनले यसको विरुद्ध पेश गरिएको समुदायको निवेदन पनि दर्ता गर्न अस्वीकार गरिआएको अवस्था छ । अझ विरोधको क्रममा विभिन्न समयमा प्रहरी र प्रशासनबाट समुदायका प्रतिनिधिहरुलाई कुटपिट गर्ने तथा ज्यानको धम्की दिने र थुनामा हाली ठुलो रकम धरौटी तिराउने कार्य भएको छ । 

२०७० असार ७ गते स्थानीय संघर्ष समितिले लाहुर्निपको सहयोगमा समुदायका परम्परागत पानीका मुहान निरन्तर प्रयोग गर्न पाउने अधिकारको संरक्षण गर्न र अधिकार उल्लङ्घनमा जिम्मेवार पक्षमाथि कारवाहीको सिफारिश गर्न माग गर्दै राष्ट्रिय मानव अधिकार आयोगमा उजुरी दर्ता गरेको छ ।

Nepal's CIAA acts on complaint regarding access to traditional water sources of indigenous community in Gorkha

In response to an informal complaint regarding obstructions to access traditional sources of water for indigenous community in Gorkha district in western Nepal, Commission for Investigation of Abuse of Authority (CIAA) has informed that complaint has been submitted to the concerned authorities.

Indigenous Gurung and Magar people in Bakrang village of the district have been denied access to freely use two major traditional sources of water located in public land for years now. The public land was sold under individual title in collaboration of few locals and land registration and measurement officials in 2008. The landowner, without information to the locals, began diverting sources for selling water to another in mid-2012 to which the locals protested and the diversion stopped.

However, the landowner, despite local opposition, has started selling water from the sources in early 2013 using local police and administration to quell local protests while they have denied registering complaint against the owner. In course of the protests, locals have been repeatedly detained and have had to pay hefty sum for bail in course of the protests besides being beaten and threatened for life.

On 4 July 2013, a struggle committee of local indigenous people, through support of LAHURNIP, has submitted a complaint to National Human Rights Commission of Nepal on the situation demanding protection of their human rights to continuously use their traditional sources of water and recommendations for actions against those violating the rights.
